1. Introduction & Acceptance

These Terms and Conditions (“Terms”) govern every purchase made through swadeshi.com.au (“the Website”), operated by Pearl Australia Solutions Pty Ltd trading as Swadeshi Goods (“Swadeshi”, “we”, “us”, “our”). By placing an order on the Website you accept these Terms in full. 

Nothing in these Terms limits, excludes or attempts to contract out of any right or remedy a customer has under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (“ACL”). Where any clause below is inconsistent with a guarantee that cannot be excluded under the ACL, the ACL prevails. 

2. Orders, Payment & Cancellation of a Transaction by a Cardholder

2.1 Order confirmation. A contract of sale is formed once you receive an order confirmation email from Swadeshi. Payment is processed securely at checkout via our payment gateway provider; Swadeshi does not store your full card number. 

2.2 Cancelling before dispatch. If you wish to cancel an order, contact us at contact@swadeshi.com.au or 0420 604 972 as soon as possible, quoting your order number. If the order has not yet been dispatched, we will cancel it and refund the full amount to your original payment method within 5 business days. Once an order has been dispatched, it can no longer be cancelled and instead falls under our Exchange & Refund Policy (clause 3) or Faulty or Damaged Items (clause 4). 

2.3 Cardholder-initiated cancellation / chargeback. If you believe a transaction was made in error, is unauthorised, or a dispute cannot be resolved directly with us, you may ask your card issuer to raise a chargeback. Please contact Swadeshi first — most order issues can be resolved faster this way than through a bank dispute. If you do raise a matter with your bank: fraud-related disputes are typically accepted within 120 days of the transaction; other (non-fraud) disputes may be raised within a longer window set by the relevant card scheme (commonly up to 540 days from the transaction or expected delivery date). Swadeshi will respond to any chargeback notification from our acquiring bank within the timeframe it sets (typically 14 days) and may provide evidence of the order, delivery and any correspondence with you. 

2.4 Unauthorised transactions. If you believe your card has been used without your authorisation, contact your card issuer immediately as well as notifying Swadeshi. 

3. Exchange & Refund Policy (Change of Mind)

We want you to love what you order. If you simply change your mind about a product, Swadeshi offers an exchange or refund subject to all of the following conditions: 

  • Timeframe: the request must be made within 30 days of the delivery date. 
  • Condition: the product must be unworn, unused and unwashed, with all original tags, labels and packaging attached and intact, and in a condition suitable for resale. 
  • Proof of purchase: your order confirmation or receipt must be provided. 
  • Postage: for a change-of-mind return or exchange, the customer is responsible for the cost of returning the item to Swadeshi. Original delivery charges (if any were paid) are non-refundable in change-of-mind cases. 
  • Items listed as excluded from return under clause 6 cannot be exchanged or refunded under this change-of-mind policy. 

A change-of-mind exchange or refund is offered at Swadeshi's discretion as a customer service policy. It is separate from, and does not reduce, your rights under the Australian Consumer Law for faulty or damaged goods (clause 4). 

4. Faulty or Damaged Items

If a product arrives faulty, damaged, or not as described, you are protected by the consumer guarantees in the Australian Consumer Law, which apply regardless of any policy in these Terms and cannot be excluded, restricted or waived. 

  • Major failure (e.g. the product is unsafe, significantly different from its description, or cannot be repaired within a reasonable time): you may choose between a full refund or a replacement. 
  • Minor failure: Swadeshi will remedy the problem, typically by repair, within a reasonable time; we may also offer a replacement or refund at our discretion. 

Postage for faulty or damaged items: where a product is confirmed faulty, damaged in transit, or not as described, Swadeshi will pay the return postage and will not charge for the cost of any repair, replacement or redelivery. 

To start a claim, contact contact@swadeshi.com.au with your order number, a description of the fault or damage, and photos where possible. We may ask for the item to be returned for inspection before a remedy is provided; where postage is our responsibility under this clause, we will supply a prepaid return label or reimburse reasonable postage costs. 

5. How to Request a Return & Refund Processing
  1. Email contact@swadeshi.com.au (or use the returns form on the Website, once live) with your order number, the item(s) you wish to return, and the reason (change of mind, fault/damage, or other). 
  2. We will confirm eligibility under clause 3 or clause 4 and provide return instructions, including whether a prepaid label applies. 
  3. Post the item back to us. Keep proof of postage until your return is confirmed received, particularly for change-of-mind returns where you are responsible for the postage cost. 
  4. Once received, we will inspect the item within 3 business days. 
  5. Approved refunds are issued to your original payment method within 5–10 business days of the item passing inspection. Approved exchanges are dispatched within the same timeframe, subject to stock availability; if the replacement item is unavailable, we will offer a refund instead. 

Where a refund is approved, we refund the price paid for the item(s); original delivery charges are refunded in full only where the return is due to a fault, damage, or an error on our part. 

6. Items Excluded from Change-of-Mind Return
  1. For hygiene, customisation and safety reasons, the following are not eligible for change-of-mind exchange or refund under clause 3 (they remain covered by your non-excludable ACL rights under clause 4 if faulty, damaged or not as described): 

    • Innerwear, blouses cut/stitched to individual measurements, and other made-to-measure or custom-tailored items. 
    • Earrings and other pierced jewellery, for hygiene reasons. 
    • Books and printed items (Sahithi range) once their packaging/shrink-wrap has been opened. 
    • Gift cards and vouchers. 
    • Items marked as final sale/clearance at the time of purchase, where this was clearly stated on the product page before you completed your order. 
7. Amendments to These Terms
  1. Swadeshi reserves the right to review, update or amend these Terms at any time, including to reflect changes in our products, processes, or applicable law. The version of these Terms published on the Website at the time you place an order applies to that order. We recommend reviewing these Terms each time you shop with us; continued use of the Website after an update constitutes acceptance of the amended Terms. 

8. Delivery & Shipping Timelines
  1. Estimated delivery timeframes depend on your delivery address and whether the item is ready-to-ship or custom-made. The ranges below run from dispatch, not from when the order is placed; production time for custom orders is separate and already included in the custom-order estimate. 

    • Sydney metro: 2–5 business days 
    • Rest of New South Wales: 5–7 business days 
    • Rest of Australia: 7–10 business days 
    • Custom-made Indian ethnic wear (made-to-order designs): 15–20 days, covering production/tailoring in India, international shipment and local delivery within Australia 

    At checkout, an estimated delivery date or date range is calculated for your delivery address and the items in your cart, and is displayed to you before you complete your order. 

    These timeframes are estimates, not guarantees, and can be affected by factors outside Swadeshi's control, including customs clearance, peak shipping periods (e.g. the festive season), carrier delays, or events such as natural disasters. If dispatch of your order is significantly delayed, we will let you know; you retain the right to cancel an undispatched order under clause 2.2. 

    Tracking details are provided once your order is dispatched, where supported by the carrier. 

9. Privacy & Security of Your Account Information
  1. 9.1 What we collect. When you create an account or place an order, Swadeshi collects the personal information needed to do so — your name, delivery and billing address, phone number, email address — together with your order details and order history, all held securely within your customer account. 

    9.2 Why we collect it and how we use it. We collect and use this information exclusively to deliver the orders you request and to manage your order history and related account services for you — for example, confirming and dispatching orders, keeping you updated on delivery, handling returns/exchanges/cancellations under clauses 2–6, and letting you view your past orders. We do not use your account details for any other purpose. 

    9.3 Who we share it with. We do not sell, rent or share your personal information with third parties for their own marketing or other unrelated purposes. We disclose only what is necessary to the parties who help us fulfil your order — our couriers/freight partners (to deliver your parcel) and our payment gateway provider (to process payment) — each bound to use it only for that purpose, or where we are required to by law (for example, a request from NSW Fair Trading, the ACCC or a law enforcement body). 

    9.4 Card/payment data. Swadeshi does not see or store your full card number. Payment is captured directly by our PCI DSS–compliant payment gateway (via a tokenised checkout), which returns only a payment token/transaction result to us — never the raw card number. 

    9.5 Security measures we have in place. To protect the personal and account information described above, Swadeshi maintains: 

    • Encryption in transit: the Website uses HTTPS/TLS site-wide, including at checkout and account login. 
    • Encrypted, access-controlled storage: customer account data is held in an encrypted database, accessible only to authorised Swadeshi personnel on a need-to-know basis. 
    • Account authentication: customer accounts are password-protected; we recommend using a strong, unique password. 
    • Restricted administrative access: access to the Website's backend and customer database is limited to authorised staff, protected by strong authentication (e.g. multi-factor authentication) and logged. 
    • No storage of card numbers: as set out in clause 9.4, full card data is handled entirely by our PCI DSS–compliant payment gateway, not stored on Swadeshi's systems. 
    • Patching & monitoring: our website platform, plugins and hosting environment are kept up to date and monitored for unauthorised access or suspicious activity. 
    • Data breach response: if a data breach involving your personal information is likely to result in serious harm, we will act in line with the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth) — notifying affected customers and the Office of the Australian Information Commissioner (OAIC) as required. 

    9.6 Retention. We retain your account and order information for as long as your account is active, plus any further period needed to meet our tax, accounting and legal record-keeping obligations, after which it is securely deleted or de-identified. 

    9.7 Your rights. You may ask us to access, correct or delete the personal information we hold about you, or close your account, by contacting contact@swadeshi.com.au. We will respond within a reasonable time. 

10. Governing Law & Contact
  1. These Terms are governed by the laws of New South Wales, Australia, and the applicable laws of the Commonwealth of Australia, including the Australian Consumer Law.
